3. Counter-Notification

If you believe that material you posted was removed by mistake or misidentification, you may submit a counter-notification to our Designated Agent containing the following:

1. Your physical or electronic signature
2. Identification of the material that was removed and the location where it appeared before removal
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in the district where you reside (or Kitsap County, WA if outside the U.S.)

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Berryman Brokers maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

5. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please ensure your notices are accurate before submitting them.
